Legal states question: Can you legally sell your excess?

Just curious if any states allow you to sell your excess harvest to a dispensary without an expensive license of your own?

For New Mexico, the answer is no. It may depend highly on the jurisdiction. But I’m going to take a wild stab at “no f**king way.” It defeats the purpose of government regulation and capitalist oversight. If a home grower could sell to a dispensary, the license required for commercial grows would be arbitrary. Testing would either be waived or shifted to the dispensary, rather than the grower. That’s not in the spirit of the legal states’ mantra of “fee for this, fee for that.”

I don’t mean that to sound so charged, but I’m afraid it’s the reality that is becoming more normalized across the legal states. Why not cater to seasoned industry insiders who have loads of money to burn setting up in each new state? It’s a win win for industry and the State coffers.

I did read somewhere about a state trying to legalize micro growers opportunity to sell to dispensaries.
What the legal definitions and details would be was not clear. I forget which state it was.
Here in Missouri excess product (lol) and anything you have leftover if you give up your license has to be returned to a dispensary after getting authorization to do so and without any compensation.

The state is in the process of amending the laws so we shall see what happens.

WA too, if you don’t have a medical prescription your not legal to have an plants growing. Your prescription has to state how many plants you “need” if you grow more than 4 at a time and even that is capped at 15. And of course all the dispensary and grow license are gone only transport license left.

Having a med card changes the rules. In Mass I can gift ounces to people. If you have a med card you’ll be prosecuted for distributing controlled medications for doing the same.

We can have up to 12 plants (6 per adult in household) but only 10oz in total. Nonsense

I’m so glad I’m allowed to keep whatever I produce and gift it freely. Obviously selling is illegal but I can give it away all day every day as long as no one is transporting more than something ridiculous like 4oz at a time.

I give most of mine away to a few family members and a friend. I don’t smoke much. I gave my Nephew a 1/4 pound once to give to his golf buddies. lol. I had like 16 ounces at the time. I probably only smoke 2 ounces a year.

I just got a shit ton of those little gram ziplocks? With the silly pictures printed on them? Like bombs and hearts and 8 balls and shit? I am gonna load up a bunch of them and start handing them out around town. Giving them as tips at the coffee shop and shit. Gonna be the most popular dude in town. :alien:
