A friend of mine has been asking me to help her find out what the outdoor cultivation laws are for New York State for home growers. And for the life of me i cannot find anything on it. It vaguely mentions indoor growing and the only mention of outdoor grows is for licensed farms. Does anyone have anything on this before she just goes rogue and does it anyway
NY really doesn’t have their poop in a group I’m not sure they have any regulations yet what I do know is your supposed to have medical card to grow in your house so I assume that goes for outside also 3 mature and 3 immature person up to 2 person’s per household. They have decriminalized possession so not sure what they will do if anybody knows anything different clue us in
Ive scoured the nys laws for weed. And the only thing im finding is for medical use and caregivers. Which is bs considering the way it was written up intially made it seem as if anyone could grow up to 6 plants.

Home Cultivation
Adult-use home cultivation of cannabis plants is currently not allowed. Pursuant to the MRTA, the home cultivation of cannabis plants may only be permitted after the Office of Cannabis Management issues regulations governing home cultivation of cannabis, which must be no later than 18 months after the first adult-use retail sale.
Once permitted, New Yorkers 21 years and older can grow up to six plants in their home for personal use (3 mature plants and 3 immature plants) and a maximum of twelve plants per household (6 mature plants and 6 immature plants), even if there are three or more adults 21 and over in the residence.
Cannabis plants must be kept in a secure place and not accessible to any person under 21.
Home cultivated cannabis cannot be sold to anyone and is only intended for personal use.
Please note, it is illegal to make cannabis hash oil or concentrates using substances like butane, propane, or alcohol with home grown cannabis.
Local municipalities may enact and enforce regulations relating to home cultivation of cannabis provided, no municipality may completely ban or prohibit home cultivation.

This is from the written law on their website and it says…
(b) plant, cultivate, harvest, dry, process or possess, within his or
her private residence, or on the grounds of his or her private
** residence,** more than three mature cannabis plants and three immature
cannabis plants at any one time;
So you can grow outside according to their law

Its kind of the same here in Missouri. I am guessing for other states as well. We can grow outside if its not visible off property and not accessible to others. An enclosed area. But does that mean if my yard is fenced off and locked that I am in compliance or do I have to have a separate locked off space like a dog pen with opaque sides? Plus the law states no actual penalty for non-compliance. The bigger risk is someone stealing the plants before we actually get to harvest them. Law enforcement at this point has to realize that they have no hope of stopping this. In some areas they have given up, but you always got some buckaroo officer who wants to be a bully and get his jollies harassing someone. Many of them still don’t know their own state laws. One day hopefully it will be as common as tomato plants in everyone’s garden. But I fear that’s gonna be long after i am dead and gone.

Well that stinks. Put a law on the books that allows it but only after something else happens.

WA is like that, it’s okay to buy recreational but not to grow it. If you have a medical card there’s a little leeway but otherwise nope. And the 2018 farm bill allows hemp “according to state guidelines” but WA doesn’t have any hemp guidelines written. So yeah wild west- there’s been some threads on outdoor grows that they camouflaged their plants with fake flowers.
I am surprised that Missouri has done such a decent job of writing their laws. Here we sit in the bible belt and a mostly conservative state, but St. Louis and Kansas City along with Columbia, (A college town), have driven the voting to get it done. 6 plants in flower and 6 in veg plus if you clone add 6 small clones for a single grower is more than enough to keep a few people in weed. I only flower 2 or 3 at a time as that’s all I can fit in the tent. I will start a new batch about 3 weeks before I harvest. The requirement if you actually follow the law is they must be in a locked grow space only the licensed grower can access. Not a bad idea for any grower who wants to keep their plants and I would do this even if it was not the law. So I don’t know how we got reasonable laws but I am glad we did. Its still a good idea to keep it secret from others just for safety sake.

Possession isnt an issue but from my undestanding so far they dont know what theyre doing yet. The laws havent been written for personal grows and are kind of on hiatus for up to 18 months from Jan 1st 2023
I know this subject matter intimately. New York State passed their cannabis legislation the same year New Mexico did. They wrote very similar laws. New Mexico was more generous, but the idea is the same.
Home cultivation in NY state is limited to 6 plants (3 in veg, 3 in flower) per person with a household maximum of 12, (6 and 6) regardless of persons.
Their citations really are a different animal to me, but they passed the subsequent regulations required to permit home growing back in 2022.
Section 222.15 permits cultivation of “personal” cannabis, it doesn’t state recreational or medical, which means both are allowed.
They also passed Part 115 which specifically addresses Medical cannabis. An individual with a medical card in NY can grow up to 6 and 6, regardless of household size.
Anyway, that is all to say that yes indeed. Anyone over the age of 21 in New York State can grow.
