I searched the forums for “high THCa hemp” but I didn’t get any hits. But if this topic has already been discussed I apologize in advance for the redundancy. Only recently I came across a description for high THCa hemp and the loophole in the 2018 Farm Bill that allows cannabis plants that contain high levels of THCa and low levels of Delta 9 (0.3 % or less) to be legally sold as hemp. At first I scratched my head about this. But after reading another forum about the odd DEA designation of what constitutes hemp I had a good laugh about it. I found a site that sells high THCa hemp (there are many now) and ordered some Gorilla Glue and Green Crack – that ended up being delivered right to my mailbox . Yes, those are famous cannabis strain names. I also received detailed chemical analysis of my purchases along with a letter from a law firm describing why my purchases are perfectly legal. The analysis of both strains revealed that Delta 9 THC was well below the 0.3% amount, therefore, according to the DEA, my purchases are classified as “hemp”. However, the THCa concentrations were in the 20%+ range. Now, if you’re familiar with what happens when THCa is heated, or decarboxylated, you know that THCa is converted to Delta 9 THC. This strange oversight in how the DEA defines hemp will certainly change in time, I suspect sooner rather than later (the USDA disagrees with the DEA and suggests that the total THC amounts should be tested, not just Delta 9). Some states already have passed total THC laws. The state where I currently reside does not, hence my legal purchase. I prefer growing my own cannabis, specifically buying seeds from ILGM. But for now I’m enjoying the DEA’s baffling misstep.
